Concerned not only to obtain compensation for those already injured, Steve has played a preeminent and pioneering role in shaping our law to save lives and prevent or minimize injuries. Over thirty years ago, in the groundbreaking and frequently cited case of Ayers v. Township of Jackson Steve established the right to medical surveillance as a remedy, permitting the victims of wrongful exposures to toxins, the chance to obtain medical examinations that might detect at the earliest moment developing disease so that it might be treated and cured. Diane is an accomplished trial lawyer concentrating in medical malpractice, complex product liability, environmental torts, civil rights, construction accidents and other personal injury cases. She has achieved substantial verdicts and settlements in catastrophic injury cases, and has handled cases as diverse as the negligent administration of blood products, cancer misdiagnosis, cerebral palsy, surgical and obstetrical mistakes, and emergency room failures. Diane has represented countless people hurt by corporate malfeasance, obtaining substantial recoveries for victims of asbestos disease, Vioxx consumer fraud, and exposure to toxic chemicals in the semiconductor industry. Over the years the health and safety of women have been Diane’s special concern. Diane has successfully handled cases involving important women’s health issues like the DES and Dalkon Shield litigations, which concerned a defective pregnancy drug and a defective birth control device, respectively, which caused innumerable women to suffer infertility, pelvic inflammatory disease and cancer. She has also represented women who were victims of sexual harassment and on-the-job gender discrimination. Diane has focused on vindicating the rights of women wrongfully exposed to mercury, arsenic, and other toxic heavy metals and chemicals, which wreak havoc with their reproductive systems, and cause them to be infertile or bear children with horrific birth defects. She has a deep interest in protecting women and children injured by American corporations who shamelessly take their dangerous products abroad. To that end she has undertaken the representation of innocent families from the poorest areas of the Dominican Republic and Argentina, who were wrongfully exposed to the harmful constituents of coal ash waste and to pesticides used in tobacco farming. Diane has also promoted workplace safety issues by prosecuting death and injury cases under the Federal Employer Liability Act and the New York State Labor Law. She has advanced employee protection under federal, state, and city anti-discrimination legislation by representing workers who have suffered unequal treatment because of race, age, gender, or disability. Diane has secured millions of dollars in verdicts and settlements for her clients over the years. Spadafora, et al., Supreme Court, Suffolk County, as determined by the New York Law Journal, published in New York Magazine. This entire verdict was affirmed on appeal in 2017 In 2008, Dan obtained a $8.5 million verdict on behalf of a young child, catastrophically injured from exposure to lead based paint due to his landlords’ negligence.       <image:caption>OF COUNSEL Russell J. Curley joined Phillips &amp; Paolicelli as of Counsel in 2023, focusing his practice on mass tort litigation. Prior to joining Phillips &amp; Paolicelli, Russell was a state prosecutor for the New Jersey Attorney General’s Office and the Middlesex County Prosecutor’s Office, where he oversaw complex financial fraud investigations, public corruption investigations and prosecuted a wide variety of cases including murder, racketeering, money laundering, theft, tax evasion, drug trafficking, bribery and mortgage fraud. Russell served as Section Chief of the Special Prosecutions unit and the Gang &amp; Drug Trafficking unit, where he oversaw a variety of complex investigative techniques including wiretaps, undercover operations, cooperating informants, and the use of GPS tracking devices. Russell tried numerous jury trials to verdict, and handled appeals before the New Jersey Supreme Court, and the New Jersey Superior Court, Appellate Division. Russell is a 1994 graduate of Brown University and 1997 graduate of Rutgers University School of Law – Newark, and is admitted to practice in New York and New Jersey, the U.S. District Court for the District of New Jersey, the Third Circuit Court of Appeals, as well as the United States Supreme Court.
